Hudud is catalyst to more crime, Karpal claims
GEORGE TOWN (Oct 30, 2011): DAP chairman Karpal Singh has claimed the implementation of hudud will usher more crime, as criminals will not be easily convicted in Islamic courts due to its stringent requirements.
“If you have hudud law, it would be impossible to have a conviction. It would give free reign for criminals because it would be impossible to prove a case to the point of certainty,” he told a press conference here, today.
The Bukit Gelugor MP said the argument that hudud law can deter crime is not well supported, citing adultery as an example, as a person can only be convicted if there are four eye-witnesses who are upright Muslims.
"This is an impossible scenario," he said.
Karpal said in the early 1990s, he had questioned the Home Minister in Parliament about whether there had been improvement in the crime situation after the Dangerous Drugs Act 1952 had been amended in April 1983 to make certain offences carry a mandatory death sentence without any option of life imprisonment.
“The answer was that there was an increase (in number of cases),” he said.
Karpal was commenting on Kelantan executive councillor Datuk Mohd Amar Nik Abdullah's reported statement that the state is proposing to amend civil laws so that punishment on criminals can be meted out in a way provided by hudud law.
Mohd Amar reasoned that this is necessary to make punishments fair to both Muslims and non-Muslims.
Karpal stressed that it is a misconception that hudud, through its severity in punishment like amputating arms and legs, would deter would-be criminals from committing offences by instilling fear.
In civil law, he added, the punishments that can be meted out are severe enough to deter would-be criminals, noting that the Penal Code has been amended to impose longer jail terms for various offences.
“The DAP will ensure that hudud law and the Islamic state are not part of the Pakatan Rakyat’s common policy framework and manifesto,” he stressed, adding the DAP was cooperating effectively with PAS on “larger issues” like human rights and corruption, on which they had forged mutual agreement.

karpal cakap begitu mungkin sebab dia jahil tentang huduh dan undang2 islam.....nanti dia paham la tu...kite tak perlu bimbangkan dia, dia hanyalah seorang hamba ALLAH macam kite jugak, yang perlu kite takutkan adalah ALLAH. undang2 Islam bukanlah untuk diundi, kite jalankan dulu baru kite akan nampak hasilnye.....
